1. Good Faith & Legal Compliance

GameTorch, LLC ("GameTorch", "we", "us", or "our") operates in good faith and strives to comply with all applicable laws and regulations. We are committed to providing a safe, creative, and respectful environment for all users.

2. Limitation of Liability

GameTorch is provided 'as is' and 'as available.' To the fullest extent permitted by law, we disclaim all warranties, express or implied, and will not be liable for any damages, losses, or claims arising from your use of the service, including but not limited to lost profits, lost data, or business interruption. You use GameTorch at your own risk.

We reserve the right to remove any content or suspend accounts at our sole discretion, especially if we believe content could expose us to legal claims or criminal liability.

We also reserve the right to arbitrarily delete any data, content, or account without notice and for any reason. While we act in good faith and only intend to do this to mitigate our legal and financial risks, not in pursuit of any specific ideology, you acknowledge that your data may be removed at any time.

3. Copyright & Takedown Requests

We respect intellectual property rights. If you believe any content on GameTorch infringes your copyright or other rights, please send a detailed takedown request to compliance@gametorch.app. We will promptly review and, if appropriate, remove the material.

We reserve the right to remove any material that we believe could result in legal action or criminal charges against us.

4. Content & Publishing

• Private by Default: All assets you generate are private to your account by default.
• Creative Commons Publishing: You may choose to publish assets to the public Creative Commons gallery. Once published, these assets are available to everyone under the Creative Commons Zero license.
• No Model Training Without Notice: We will never use your private data or assets to train AI models unless we notify you and obtain your consent. However, third-party service providers may have their own data policies.

5. Published Items & CC0 License

All items that you choose to "publish" (including assets, edits, spritesheets, and workshop items published to the public Creative Commons gallery) are released under the CC0 Creative Commons Zero license. This means anyone can use, modify, and redistribute your published items for any purpose, without restriction. For more information, see the official CC0 page.

6. Refunds & Credits

• No Guaranteed Refunds: All purchases are final and non-refundable. However, we act in good faith and have code in place to automatically refund credits whenever possible (for example, if an image generation fails). We also reserve the right to issue refunds at our sole discretion.
• Credit Expiry: Credits purchased or earned on GameTorch expire 1 year after the date of purchase or award.

7. Third-Party Services

To provide our services, we use third-party providers who may process or store your data:

• Google Cloud (hosting and storage)
• OpenAI (AI model inference)
• Replicate.com (AI model inference)

These providers have their own privacy and data policies, which may differ from ours.

8. Data Collection & Privacy

• Minimal Data: We only collect information necessary to operate GameTorch, such as your email address for account access and recovery.
• No Email Sharing: We will never share your email address with third parties.
• No Billing Data Storage: We do not store your billing information or physical address. Stripe, our payment processor, handles all billing data. We only store the email you use with Stripe to help you manage your subscription.
• No Marketing Emails: We will never send you marketing emails or newsletters. The only emails you will receive from us are one-time sign-in codes and password reset links.
• No Data Sale: We do not sell your data to third parties. We do not use your data for any purpose other than to operate GameTorch.

9. Cookies & Session Data

We use only essential cookies (session IDs) to keep you logged in. These are never shared or used for tracking or advertising. We do not use any other cookies or tracking mechanisms and we never sell your data.

10. User Conduct

You agree not to use GameTorch for any unlawful, harmful, or abusive purposes. We reserve the right to suspend or terminate accounts that violate these terms.

11. Changes to These Terms

We may update these terms and policies from time to time. If we make significant changes, we will notify you via the website or email.
